In Impeach Activist Judges I provided a weblink to Larry Auster’s insight, gleaned from “Federalist No. 51,” along with the entire text of No. 51.
In that posting, I noted:
“Thomas Jefferson was at that time sitting as the third President of the United States. Both Jefferson and James Madison (the “Madison” cited in the case name) vociferously opposed Marshall’s appropriation of power. It is thus ironic that Democrats, who claim Jefferson as the founder of their party, are the strongest supporters of judicial activism today. “
